数据开源生态的法律构造:从来源合法到协议利用

    Legal Structure of Open Source Ecosystem of Data: From Source Legitimacy to Protocol-based Utilization

    • 摘要: 开源数据是指根据特定开放许可协议发布的、允许用户自由访问并协作开发的公开数据集合。开源数据不同于公开数据,开源数据在权利让渡程度上更弱,且以开源协议作为确定各方权利义务的基础。数据开源协议属于附解除条件的合同。在开源数据集创设阶段,开源平台可在满足四要件的合法性限度内采集已公开数据。在个人数据来源者和开源平台之间,应充分尊重个人的拒绝权;在非个人数据来源者和开源平台之间,可引入转换性使用制度判断数据来源合法性。在开源数据集再利用阶段,用户可就开源数据集进行非营利性使用,但在营利性使用场景下应坚持数据开源协议对于再利用范围的约定。

       

      Abstract: Open-source data is publicly available data released under specific open licensing agreements, which can be freely accessed and collaboratively developed by users. Distinct from public data, open-source data involves a weaker degree of rights transfer and uses an open source license to define the rights and obligations of all parties. Such licenses constitute contracts subject to a condition subsequent. During the creation of open-source data, open platforms may collect publicly available data within the legitimacy limits that satisfy the following four essential requirements. Between personal data subjects and open platforms, individuals’ right to opt out shall be fully respected; between non-personal data subjects and open platforms, the doctrine of transformative use shall be introduced to determine the legality of data sources. As for the reuse of open-source data, users may use open-source data for non-commercial purposes, but in commercial use scenarios, the scope of reuse defined in the open source agreement shall be strictly observed.
