从“效率优先”到“正义感知”:数字平台纠纷解决的主观程序正义转向

    From “Efficiency Priority” to “Perception of Justice”: The Turn to Subjective Procedural Justice in Digital Platform Dispute Resolution

    • 摘要: 以平台裁决制和大众评审制为典型代表的数字平台纠纷解决机制具有鲜明的效率导向,与此同时面临结构性上限、系统性下限和相对性局限的桎梏。协调或者缓和个人正义的愿望和需求与快速、有效和经济地解决数字争端之间的矛盾,关注数字纠纷中以消费者或者用户为主体的话语叙事和现实需求显得极为重要。以主观程序正义理论为基础,构建包含程序参与效能感、程序尊严体验感、程序公平认知度和程序透明感知度的四维正义感知模型,并通过具体的制度设计和规则设置将其转化为正义感知的实践效能。主观程序正义理论在数字平台纠纷解决中的应用还应充分注重客观规则的设置和基本事实的存在。

       

      Abstract: Digital platform dispute resolution mechanisms epitomized by platform adjudication and peer jury systems feature a distinct efficiency orientation, yet are constrained by structural ceilings, systemic bottom-line constraints and relative limitations. It is critically important to reconcile tensions between individuals’ aspirations and demands for substantive justice and the need to resolve digital disputes expeditiously, effectively and cost-efficiently, alongside focusing on the discursive narratives and practical needs of consumers and end users as core stakeholders in such disputes. Rooted in the subjective procedural justice theory, this paper constructs a four-dimensional perceived justice model encompassing perceived efficacy of procedural participation, perceived dignity in procedural experience, perceived procedural fairness and perceived procedural transparency, and translates the model into tangible practical effects of justice perception via targeted institutional arrangements and rule formulation. The application of subjective procedural justice theory to digital platform dispute resolution must also attach sufficient importance to the formulation of objective rules and ascertainment of underlying factual circumstances.
