Proper Care Rights as Human Rights of Minors and Its Structure

The proper care is a basic human right enjoyed by the minors. It includes basic life rights and autonomy rights. Based on empirical analysis of children in China, we find that there are two tendencies in the implementation process of Chinese minors’ right to proper care. The first is a tendency related to the issue of the relationship between the minors and care. The second trend relates to the responsibility of state as a moral obligation or a liability. If we want to settle these questions, Chinese government should deal with the relation between the basic life rights and the autonomy right, reinforce government’s responsibility, and complete the law system on proper care rights to minors.
