A Study on the Criminal Law Amendment(VIII)Concerning the Provisions of the Environmental Pollution Crime

The Criminal Law Amendment(VIII)has made important amendments to the 338th Article of the Criminal Law, changing Crime of Severe Environmental Pollution Accidents to Crime of Environmental Pollution. This has greatly transformed the concepts of law enforcement in this respect. By revising the objective conditions of the crime, the amendment has lowered the criminalization threshold, expanded criminal responsibilities and facilitated the punishment of environmental pollution. However, it has also brought about the problems of the conviction of potential damage offence in environmental pollution and other related issues, which need to be further clarified.
