Study and Significance of the Legislation Trend in France on the Relation between Contractual Responsibility and Tore Responsibility — Starting from the Catala Draft

France is reforming her obligations law system,and the Catala Draft prepared by experts suggests that the“contractual responsibility”concept should be introduced into the French Civil Code. This suggestion has been recognized by a special Assessment Team attached to the Parliament. The Team denies the framework imagined by the Catala Draft in which the contractual responsibility and tort responsibility are together treated under a common title“civil responsibilities”and share the same general provisions. However, the Team supports the principle,fixed in the Draft,to the cumulative responsibilities,between these two responsibilities: allowing exceptions,the contractual responsibility rules in principle overlap the tort responsibility rules. The views of the Parliament’s Team indicate the French legislative trend in the field of civil responsibilities which is of great significance for the comparative study.
