Legal and Case Analysis of AD/CVD Investigations and its Impact on China

Since China is now a rising power in world trading system. United States and EU have changed their customary practices，which do not take countervailing investigations against NME countries. Instead，they levy AD Duties and CVD Duties on China products. As countermeasures，China also takes AD/CVD investigations. Having made thorough analysis，we may conclude that the critical points focused on whether domestic subsidies lower prices. Even if China is defeated in WTO dispute settlement proceedings，we may defend our interests by asking investigation body to prove that there is no double-counting in the application of AD/CVD Duties.
