Across the Strait Comparative Study of Criminal Trademark Violations

The protection of trademark rights under criminal law has increasingly drawn the attention of mainland China and the Taiwan region, and the criminal law relating to criminal infringement of trademark rights clearly influences the protection of trademark rights. However, by comparison, crime legislations on copyright infringement, charges and penalties are different across the strait. Mainland China should draw lessons from the Taiwan region on the legislation on copyright infringement in order to increase the protection of trademark rights and improve the management of related criminal violations.
