On the Retrial System in China

This paper proposes that in the configuration and implementation of retrial system in China, a tendency of administration overreaching and interfering judicature independence is palpable and severely affects judicatory justice and efficiency, deviating from the original goal of retrial system. The paper compares the Chinese retrial system with its counterparts in several countries and puts forward a reconstruction of retrial system in China.
