On the Grant of Patent Right for Geneorder

This paper discusses the grant of patent right for Geneorder from the following three aspects: the dispute on the character of geneorder (invention VS discovery); the analysis of the inventiveness and practicability of Geneorder; and the influence of so-called gene related patent rights on public interests. A conclusion of the research is that there is no reasonable and sufficient excuse to prevent Geneorder from the protection of patent right theoretically but the protections of patent rights in different countries should be in accordance with their specific situations such as their own magnitude of Geneorder occupancy ,development on the biological technology, etc.
