The Evaluation of the Legal Position of Administrant of a Bankrupt Enterprise

This paper, through evaluating the legal positions of administrant in different countries, argues that the theories on the bankrupt consigner in Britain- America legal system are more reasonable. It points out that China's new Bankruptcy Law should make the bankrupt consigner the administrant in the bankrupt enterprises. Clarifying the legal positions of administrant in bankrupt enterprises is very crucial to legislation and judicatory of Bankruptcy Law.
