An Exception for Forced Attestation——On the Legislation of Setting an Exemption Right for Relative Attestation in Criminal Litigation

It is an inevitable trend in the development of criminal litigation in China and urgency in legislation to set up a right to refuse to attest for attesters' relatives as an exception in forced attestation. On the advent of the establishment of Attestation Law in China, this article points out an appropriate recognition of exemption right and the subject for attesters' relatives, and the possibility of setting this exemption right in the future Attestation Law, while at the same time maintaining the reasonable elements in the current Criminal Law.
