Copyright System Addressing Digital Cultural Production: From the Principle of Configuration Rights to Rules Design

The emergence of digital culture production has posed challenges to the traditional copyright system, including difficulties in defining the protection scope, determining rights ownership, and fulfilling the incentive function. Copyright empowerment is based on the formation of the cultural market, with the aim of promoting cultural cumulative innovation and enhancing the competitive advantage of rights holders, rather than directly providing economic incentives to them. Based on this, in the face of various challenges brought by digital culture production, it should be recognized that the intellectual contributions of users align with the essential requirements of cumulative innovation. User-generated content that is identifiably different and of reference value should be included within the scope of copyrightable works, and the authorship of users should be acknowledged. Besides, the randomness of artificial intelligence technology is not a reason to deny users the copyright. Additionally, to address the imbalance of interests in the digital cultural production process, the private power of digital platforms should be restricted by allocating additional obligations, while a Pigouvian tax-based compensation system of work model training should be established to compensate for the potential harms to rights holders, ultimately ensuring the sustainability of the cumulative cultural innovation process.
