Abstract:
The life of the law lies in its implementation, and the implementation of the Civil Code plays an important role in social governance. Experts believe that the civil code should be used as the analytical framework to construct the theoretical system and discourse system of civil law. The Civil Code plays an important role in the effective governance of the self-media, e-commerce and real estate market, and also provides an institutional basis for the compilation of environmental code and the formulation of Basic Law of Intellectual Property Rights in the future. In terms of value guidance, the principle of good faith in the Civil Code can implement the value of good faith in case judgments and civil law teaching. The principles of equality and freedom in the Civil Code also provide a broader institutional space for the development of commercial law. In terms of system supply, the new provisions of the Civil Code related to the guarantee system provide support for the creation of a good business environment. At the same time, the reform of the “separation of three rights” of rural homestead and contracted land is also being promoted in practice. The Personal Information Protection Law further implements the protection of personal information in the Civil Code.
