Abstract:
In the ancestral grave cases of Hunan in the Republic of China, the geomantic customs were applied widely, and they promoted the solution to the disputes forcefully. This was inseparable from the social concepts, legal provisions and the judicial precedent system at that time. The "General Principles of Civil Code" has stipulated customs the status of abstract legal source. However, there are still a lack of applications of civil customs, applicable rules and standards of trial in judicial practice. Reviewing the history can provide useful enlightenment for the present. In today's judicial practice, it is necessary to strengthen the use of customs, to carry out civil customs investigation for judicature, and to distinguish good customs from bad ones. Especially, boundaries between the feudalistic superstitions and the normal social psychologies should be defined.
